TERMS AND CONDITIONS OF SALE
In purchasing goods from Danger Den LLC I hereby agree to the following terms and conditions: All sales are final. Danger Den does not assess sales or transfer tax on any sale. Customer is solely responsible for any and all sales, transfer or use taxes imposed by any governmental authority on the purchase of Danger Den products. Danger Den has the right to refuse to sell to anyone it chooses. Danger Den may cancel any sale in its sole, arbitrary, and unrestricted discretion. Danger Den may condition any sale on Customer's prepayment of the price and shipping costs, satisfactory verification of Customer's credit information, or on any other condition Danger Den deems appropriate in its sole, arbitrary, and unrestricted discretion. Customer's use of Danger Den products is at Customer's sole risk. Customer acknowledges that property damage or personal injury to Customer and others may result from the improper use of Danger Den products. Customer promises to use all Danger Den products strictly in accordance with Danger Den's instructions and specifications for testing and use. Danger Den reserves the right to refuse any return of merchandise sold to Customer except for merchandise returned pursuant to Danger Den's limited warranty. Customer will pay a fifteen per cent restocking charge for any returned merchandise except merchandise returned due to defects in manufacturing or materials in accordance with Danger Den's limited warranty. Danger Den will replace or repair products it sells to Customer which are defective due to manufacturing or material defects if, and only if, customer notifies Danger Den in writing of the claimed defect within 1 year following the date of sale. Danger Den will not be responsible for any damages beyond the cost of such repair or replacement. Customer agrees to pay all shipping or mailing expenses for return of defective products to Danger Den. In the event Danger Den confirms on inspection that the returned product was defective due to any manufacturing or material defects, Danger Den will repair or replace the defective product. Customer may not assign or transfer their rights pursuant to this limited warranty to any other person or entity. Danger Den may condition its duty to replace or repair any product which Customer claims is defective due to manufacturing or material defects on Customer's proof of purchase. All correspondence concerning any claims of defects in manufacturing or material and all products sent for inspection and replacement or repair pursuant to this limited warranty should be sent to: Danger Den, LLC

Danger Den will not be responsible for any damage or injury resulting: From the unauthorized or unreasonable use of its products; From Customer's failure to properly test, install and maintain its products; From any alteration or repair of its product by the Customer; From ultraviolet degradation; or From the consequences of normal wear and tear to its products. Customer is solely responsible for testing all products purchased from Danger Den in strict accordance with the instructions accompanying newly purchased merchandise. Customer is responsible for reading and strictly following all directions and instructions prior to actual use of any product. And Limitations on Liability Except as specifically stated to the contrary in the limited warranty above: ALL GOODS SOLD ARE SOLD "AS IS", WITH ALL FAULTS, AND WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, OF MERCHANTABILITY OR OF FITNESS FOR ANY PARTICULAR PURPOSE. DANGER DEN WILL NOT BE RESPONSIBLE FOR ANY CONSEQUENTIAL DAMAGES I SUFFER ON ACCOUNT OF ANY PRODUCT WHICH IS DEFECTIVE BEYOND THE COSTS OF REPAIR OR REPLACEMENT OF THE DEFECTIVE PART OR PRODUCT.
